Privacy Policy.

How we collect, use, retain, and protect your information.

This policy explains how Breqwatr Incorporated (“Breqwatr”, “we”) handles personal information about the people who visit our website, contact us, and administer customer accounts. It is written to meet our obligations under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy law.

This policy is not about the data you run on our platform. Content you upload to or create in Breqwatr Public Cloud is yours. You decide how it is handled, and we process it only on your instructions. Those commitments, including Canadian residency, our security incident notification, and deletion on termination, are in section 7 of the Terms of Service.

What we collect

Information you give us. Your name, job title, employer, email address, postal address, and phone number, along with anything else you choose to include when you fill in a form, request information, or contact support.

Account and billing information. What services you have purchased, billing addresses, and tax identification numbers. Card payments are handled by Stripe. Card numbers are entered directly with Stripe and are not stored on Breqwatr systems.

Technical information. Server logs recording IP address, browser type, pages requested, and the date and time of the request. We use network and performance monitoring data to keep our own systems secure and working.

Why we collect it

We use this information to operate and secure our website, to respond to your enquiries, to provide and support the services you have purchased, to bill you and meet our tax and accounting obligations, to send you technical and security notices about services you use, and to investigate suspected fraud or misuse.

We do not sell personal information. We do not use it for advertising, and we do not share it with advertisers or data brokers.

Where we want to use your information for marketing, we ask first, and you can withdraw that consent at any time using the unsubscribe link in any message or by contacting us.

We collect, use, and disclose personal information with your consent, except where the law permits or requires us to do so without it: to investigate a breach of an agreement, to comply with a court order or a lawful request from a regulator, or in an emergency threatening someone’s life, health, or security.

You can withdraw your consent at any time, subject to legal and contractual restrictions and reasonable notice. If you withdraw consent we need in order to provide a service, we may not be able to continue providing it.

Who we share it with

We share personal information with service providers who perform work on our behalf, such as Stripe for card payments, our accountants, and the provider that delivers messages sent from our contact page. They may only use the information to do that work for us, and they are bound to keep it confidential.

The contact form on our website is handled by a third-party provider located in the United States. Messages you send through that form are processed there. If you would rather not use it, email or call us using the details at the end of this policy.

We may also disclose personal information where we are legally required to, to respond to a lawful request from a law enforcement agency, regulator, or court, or to establish or defend our legal rights.

Where we keep it

Account, billing, and support records are held in Canada. There are two exceptions: messages sent through our contact form, and payment data held by Stripe, which processes and stores data outside Canada, including in the United States.

Customer Content on Breqwatr Public Cloud is subject to the Canadian residency commitment in the Terms of Service, which is a separate and stronger undertaking than this policy.

How long we keep it

We keep personal information only as long as we need it for the purpose it was collected, or as long as the law requires. Billing, tax, and accounting records are kept for the period required by Canadian tax law. When we no longer have a legitimate need for information, we delete or anonymize it.

Your rights

You can ask us for a copy of the personal information we hold about you, and for an explanation of how it has been used and who it has been shared with. We will respond within 30 days. There is no charge.

You can ask us to correct information that is inaccurate or incomplete.

You can withdraw consent as described above.

If you are not satisfied with how we have handled your information or your request, tell us and we will look into it. If we do not resolve it to your satisfaction, you may complain to the Office of the Privacy Commissioner of Canada, or to your provincial privacy commissioner.

Security breaches

If personal information in our care is lost or accessed without authorization and there is a real risk of significant harm to you, we will notify you and report the breach to the Office of the Privacy Commissioner of Canada, as PIPEDA requires. We keep records of security breaches whether or not they meet that threshold.

How we protect it

Access to personal information is limited to people who need it to do their jobs, and they are bound by confidentiality obligations. Information sent to and from our website is encrypted in transit using TLS. Our infrastructure and controls are subject to independent security audit, and reports are available to customers on request under a confidentiality agreement.

No system is completely secure. Protect your own credentials, and tell us promptly if you think your account has been accessed by someone else.

Cookies

This website does not use advertising, analytics, or tracking cookies. Our servers keep standard access logs as described above.

Children

Our services are sold to businesses and are not directed at children. We do not knowingly collect personal information from children.

Changes to this policy

We may update this policy. The current version is always published at www.breqwatr.com/privacy-policy/, with its version and effective date shown at the top of the page.
